Terms of Use

1. Agreement

These Terms of Use (the “Terms”) are a binding agreement between you and Sensing Apparatus LLC, a Wyoming limited liability company (“PostalGenie,” “we,” “us”), governing your use of the PostalGenie website and service (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. The Service is offered only to current residents of the United States who are physically located in the United States; it is not offered to anyone residing or located outside the United States. By using it, you represent and warrant that you are a current U.S. resident and that you meet these requirements. We may use your device's IP address to estimate your country, and may block or restrict access from outside the United States.

3. Account security and responsibility

You sign in with your email address and a one-time code. You are solely responsible for keeping access to your email secure and for all activity under your account. Because sign-in uses a one-time code sent to your email, anyone with access to your email can access your account; to the fullest extent permitted by law, we are not liable for letters sent or losses arising from unauthorized access to your email or account that is not caused by our own gross negligence or willful misconduct, and you should notify us promptly at support@postalgenie.app if you suspect unauthorized use. Provide accurate account information and keep it current. We may suspend or terminate accounts that violate these Terms.

3a. Sender representation and return address

You represent and warrant that you are the actual, authorized sender of every letter you create, the person named in the return address, and that you are not creating or sending letters on behalf of, or in place of, any other person or entity without their express legal authorization. You further represent that the return address you provide is your own genuine, accurate, and current address, and is not falsified, fictitious, or otherwise misleading. We may rely on these representations, and providing false sender information is a material breach of these Terms and may violate federal mail fraud statutes (including 18 U.S.C. § 1341).

4. The Service

PostalGenie helps you draft and physically mail letters to businesses, organizations, government offices, and individuals. Letters are printed in black and white only on standard letter-size paper; color printing is not offered. The base price covers a one-page letter; each additional page costs $0.49, and letters of 7 or more pages incur a one-time $5.99 large-letter fee. Letters may be up to 12 pages. All page charges are shown before payment. We may verify recipient addresses, but verification reduces — it does not guarantee — deliverability. The Service relies on third-party providers (see Section 11) and may change, be interrupted, or be discontinued.

Not for professional, regulated, or advice-driven use. The Service is a general-purpose tool for drafting and mailing ordinary personal correspondence. It is not intended or designed for — and you may not use it to provide, deliver, or substitute for — professional, licensed, or regulated services or advice, including legal, medical, financial, investment, tax, accounting, or insurance services or advice. Genie is an automated drafting tool, not a lawyer, doctor, financial advisor, accountant, or other licensed professional; it does not provide professional advice, and using the Service does not create an attorney–client, doctor–patient, fiduciary, or any other professional or advisory relationship. PostalGenie does not review your content for legal sufficiency, accuracy, or compliance with applicable laws or deadlines. If you need professional advice, consult a qualified, licensed professional. You are solely responsible for ensuring that any letter you create or send complies with the rules and standards governing any profession or regulated activity to which it relates. Note: PostalGenie may not be used for service of process, court filings, agency filings, or any communication requiring a legally prescribed method unless you independently confirm compliance.

We do not warrant that any letter, mailing method, postmark, tracking event, or delivery record will satisfy any legal, contractual, regulatory, court, agency, or notice requirement. If a deadline, legal notice rule, proof-of-mailing rule, or delivery requirement matters, you are solely responsible for confirming the required method and timing before using the Service.

No high-risk or consequential decisions. You may not use the Service, or any output it generates, to make — or to inform, support, automate, or influence — any decision about a person concerning credit or lending; insurance underwriting, pricing, or claims; hiring, employment, or termination; healthcare or clinical care; criminal justice; housing; or education or academic standing. The Service is not designed, tested, or authorized for these or any other legally consequential decision-making, and its output must not be relied on for any such purpose.

Recipient addresses are your responsibility. When you use automated address lookup, autocomplete, or suggestions, the results come from third-party data and may be incomplete, outdated, or incorrect. You must independently review and confirm the recipient address before paying and sending, and you are responsible for ensuring it is correct and complete. PostalGenie is not responsible or liable for mail that is misdirected, delayed, lost, or undelivered due to an inaccurate, incomplete, or incorrect recipient address, including one obtained through automated lookup. Address verification reduces, but does not guarantee, deliverability, and postage for undeliverable mail is non-refundable.

Where the Service works. Letters can be sent only to destinations served by the United States Postal Service (USPS), which is the baseline coverage area for the Service. That area consists of the 50 U.S. states, the District of Columbia, and the U.S. territories and possessions served by USPS — Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands — together with U.S. military and diplomatic addresses (APO/FPO/DPO) and the freely associated states for which USPS provides domestic-rate service (the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau). We do not deliver to any destination outside the USPS service area, and coverage within that area may change if USPS or our mail provider changes its service.

Your use of any USPS mail class or service through PostalGenie is subject to applicable USPS rules, regulations, service standards, restrictions, and operational practices, which may change from time to time.

Voice input (dictation). Where offered, you may dictate text instead of typing. Speech-to-text is handled by your device or browser’s built-in speech engine, not by PostalGenie, and is subject to that provider’s own terms. See our Privacy Policy for how voice input is handled.

5. Acceptable use

You agree not to use the Service to create or send content that is threatening, harassing, abusive, defamatory, fraudulent, deceptive, hateful, obscene, invasive of privacy (including doxxing), or otherwise unlawful, and not to use the Service for any dishonest, deceptive, or bad-faith purpose, to impersonate another person, or to send unsolicited bulk mail. You must have a legitimate reason to contact any recipient and comply with all applicable laws. The Service is for individual correspondence, not mass mailing: you may not use it to send unsolicited advertising, marketing, or promotional mail, or unsolicited commercial solicitations, or to send the same or substantially similar letter to many recipients. A single, individualized letter to a recipient you have a genuine reason to contact — including a business letter — is permitted.

Technical and platform restrictions. You also agree not to: (a) copy, modify, reverse engineer, decompile, or disassemble any part of the Service, or attempt to derive its source code; (b) access the Service by automated means (bots, scrapers, crawlers) except as we expressly permit, or scrape, harvest, or collect data from it; (c) circumvent, disable, or interfere with any security feature, rate limit, content filter, authentication, or usage restriction; (d) use the Service to build, train, or improve a competing product or service; or (e) create a new account, or use another person’s account, to evade a suspension, block, or ban. Each of these is a material breach of these Terms.

Sanctions and trade compliance. You represent and warrant that you are not located in, ordinarily resident in, or a national of any country or region subject to U.S. embargoes or comprehensive sanctions, and that you are not identified on any U.S. government restricted- or denied-party list (including the U.S. Treasury OFAC Specially Designated Nationals list). You agree not to use the Service to send mail to, or otherwise transact with, any person or destination that would violate U.S. export controls or economic sanctions. We may refuse, hold, or cancel any letter as necessary to comply with these laws.

Rights to your content. You represent and warrant that you own or hold all rights, licenses, permissions, and consents necessary to create and mail your letter and to use any material you provide or upload, and that your content — including any AI-assisted draft — does not infringe or violate any third party’s copyright, trademark, publicity, privacy, or other rights. You are the sole author and provider of your content; PostalGenie does not supply, solicit, require, or encourage any particular content. If you believe a letter sent through the Service infringes your copyright or other intellectual-property rights, you can report it at postalgenie.app/abuse (see “Abuse reports and sender blocking” below).

To protect privacy and prevent abuse, we do not offer automated address lookup for private individuals. To write to an individual, supply their mailing address yourself. We may screen letters for prohibited content and may refuse to print or mail anything that violates these Terms.

We operate automated and manual systems to detect prohibited content, tampering, and suspicious or fraudulent activity. If our systems flag such activity, we may refuse, hold, or cancel the affected letter.

Abuse reports and sender blocking. Recipients of mail sent through the Service — and any person whose rights may be affected, including intellectual-property rights holders — can report abusive, deceptive, unwanted, infringing, or unlawful mail at postalgenie.app/abuse. We review every report, and where a report is substantiated we may refuse, hold, or cancel the affected letter and block the sender’s account from sending further mail, in addition to the remedies in Section 15.

6. Your content and your responsibility

Who is responsible for what. Responsibility for a letter is divided as follows. You are responsible for the content of your letters, the recipients you choose to write to, the accuracy of any address you confirm, your legal right to send what you send, and your review and approval of the final letter before it is mailed. We act solely as a technology platform and mailing facilitator operating the drafting-and-dispatch tool itself — processing, rendering, and submitting for mailing the content you approve. The printing, enveloping, posting, and delivery of your mail, and the verification of addresses, are performed by independent third-party providers (Section 11), not by us. To the fullest extent permitted by law, PostalGenie is not responsible for your own choices about what to write or whom to write to, for the content you approve, or for the acts, omissions, or failures of those third-party providers. Nothing the Service does relieves you of responsibility for what you choose to send.

You retain ownership of the letters you create, and you grant us a limited license to process, render, print, and mail that content solely to provide the Service. You have exclusive control over, and are solely responsible for, the content of every letter you create or send — including its accuracy, truthfulness, tone, and compliance with all applicable laws (defamation, harassment, privacy, consumer-protection, and postal regulations).

PostalGenie does not independently verify the facts in your letters and does not solicit, require, or encourage any particular content. Any automated content-safety screening we apply is a basic, best-effort safeguard for our own operations — not a review, endorsement, or guarantee — and you must not rely on it. We have no obligation to monitor, screen, edit, or correct content, and any screening we choose to perform is voluntary and does not create a duty or an assumption of responsibility. We make no representation or guarantee that any letter is lawful, safe, accurate, non-defamatory, or non-infringing. We do not provide legal advice, and using the Service does not create an attorney–client relationship.

AI drafting and your approval. Genie is an automated AI system, not a person. It formats the information you provide into a letter and is designed not to add facts or claims you did not supply; you direct the content, and you are its sole author and provider. AI-generated output may vary, be imperfect, or contain errors, and you must review it for accuracy. Genie is software, not an agent of PostalGenie, and cannot make any promise, representation, warranty, or commitment on our behalf — only these Terms govern, and nothing Genie generates or states in conversation creates any obligation, warranty, or right. You are solely responsible for reviewing and approving the final letter, and no letter is printed or mailed without your explicit approval. By approving a letter you confirm that its contents are accurate and acceptable to you, and you adopt the content as your own.

Uploaded files. If you upload a file for context, any text and details we extract from it are generated automatically and may be incomplete or inaccurate. You are responsible for confirming that any details drawn from an uploaded file are correct before approving your letter.

Sensitive information. Please do not include sensitive personal data — such as full payment card numbers and security codes, Social Security or tax ID numbers, bank account or routing numbers, passwords or PINs, passport or driver’s license numbers, dates of birth, or health information — in your letters; anyone who handles the envelope could see them. Where we detect such numbers, we mask them (keeping only the last four digits) in the copy we retain, so full sensitive numbers are not stored.

7. No liability for letter content

To the fullest extent permitted by law, PostalGenie is not responsible or liable for any loss, injury, damage, claim, fine, or liability of any kind arising out of or relating to the content of any letter created, submitted, or sent through the Service — including any inaccurate facts, misstatements, or misrepresentations it contains, and how a recipient or any third party reads, interprets, relies on, reacts to, or acts on it. We do not review for legal sufficiency, accuracy, endorsement, or advice. You assume all risk associated with the content you choose to send, and you release PostalGenie from any such claims.

You understand and accept the risks. Sending a letter can have real-world legal and personal consequences — including claims of defamation, harassment, or invasion of privacy, intellectual-property disputes, regulatory or contractual exposure, or missed deadlines. As the sender and author, you bear sole responsibility and assume all risk for those consequences. The Service is a tool for transmitting your own correspondence; it is not legal advice and is not a substitute for advice from a qualified attorney.

8. Payment, pricing, and refunds

Letters are priced per recipient and charged before dispatch. Prices are shown exclusive of sales tax; any applicable sales tax is calculated and added at checkout, and you are responsible for it. Payments and any applicable sales tax are processed by our payment processor, Stripe, which acts as the merchant of record for your purchase. Once you click to pay and the order is submitted to production, the letter cannot be edited, cancelled, or refunded except for verified platform error. Address verification reduces, but does not guarantee, deliverability; postage for undeliverable mail is non-refundable. We reserve the right to change, update, or adjust our prices and fees at any time, with or without notice, prior to checkout. Any price change applies prospectively; the price that applies to your order is the one shown to you at checkout at the time you pay. You agree not to initiate chargebacks for letters that were dispatched in accordance with these Terms.

Refunds and cancellations. You can review and edit your letter — and preview the exact PDF — for free before you pay; nothing is printed, mailed, or charged until you approve and pay. Because payment and submission to our mail provider happen together, please review your letter and the recipient address carefully before paying. There is nothing to refund for an unpaid draft — if you decide not to send it, simply delete it. Postage for mail that is undeliverable due to an inaccurate or incomplete recipient address is non-refundable. If a letter fails to print or mail because of a verified error on our side, your sole and exclusive remedy is that we will, at our discretion, either reprint and re-mail it or refund the amount you paid for that letter. To raise a problem with an order, contact us (see Section 20) and we will work with you in good faith.

Any refund related to postage, tracking, carrier service failure, or a carrier-approved adjustment is subject to the applicable carrier’s rules and approval. We do not guarantee that USPS or any carrier will approve or provide a refund, credit, or adjustment.

9. Data retention

We retain the content of your letters, your conversation with the Service, and any text extracted from uploaded files, encrypted in transit and at rest, for safety and security — to detect and prevent fraud and abuse, support investigations, protect you and us in the event of a dispute or legal claim, and meet legal obligations — generally for up to 6 years from the date of the transaction (the date you pay and submit the letter for mailing), after which it is deleted. We also keep a receipt of the order (order number, addresses, tracking, and payment summary) so you have a record of what was sent. Where the law requires it (for example, an active investigation, legal request, subpoena, legal hold, or other legal obligation), we may retain relevant information longer, until the matter is fully resolved. We keep only what is necessary, limit access to it, and never sell your data.

Unpaid drafts are not deleted automatically. A draft you haven’t paid for stays in your account so you can save your work and come back to finish it later. If you decide not to send it, it is your responsibility to delete the draft yourself. PostalGenie reserves the right to delete inactive unpaid drafts at any time after 90 days of inactivity. Your return address is saved to your account (separately from any individual letter), so you don’t have to re-enter it each time. See our Privacy Policy for details.

Certified Mail tracking and delivery records are provided when available from USPS or our fulfillment provider. You are responsible for saving any records you need; availability through PostalGenie is not guaranteed beyond our stated retention period.

10. Intellectual property

The Service, including its software, design, and content (excluding your letters), is owned by Sensing Apparatus LLC and protected by intellectual-property laws; patent pending. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. If you send us feedback, you grant us a perpetual, royalty-free license to use it.

11. Third-party services

The Service depends on third parties — including a print-and-mail provider, an address- verification provider, a payment processor, and an AI/LLM provider. We are not responsible for their acts, omissions, outages, carrier delays after mail is tendered, or changes to their services. Your use may be subject to their terms.

We may preserve, review, and disclose order, mailing, tracking, sender, recipient, and letter information to our fulfillment providers, USPS, law enforcement, regulators, or other appropriate parties when we reasonably believe it is necessary to investigate fraud, abuse, unlawful activity, delivery disputes, security incidents, or to comply with legal obligations.

Physical mail fulfillment is performed by a third party. The actual printing, enveloping, posting, and delivery of your letters is carried out by an independent third-party mail-fulfillment provider and the postal carrier, not by PostalGenie. To the fullest extent permitted by law, PostalGenie is not responsible or liable for the acts, omissions, errors, mishandling, delays, loss, damage, or non-delivery of any letter by that fulfillment provider or carrier once a letter has been submitted for mailing. That said, if something goes wrong with the physical fulfillment of your letter, we will use commercially reasonable, good-faith efforts to work with our provider to investigate and remedy the situation — for example, by reprinting and re-mailing the letter where appropriate. Any such remedy is provided at our discretion as a courtesy and does not create liability or expand our obligations beyond these Terms.

Order time is not mailing time. PostalGenie is not a post office or postal carrier, and PostalGenie is not affiliated with or endorsed by the USPS. The date and time you place or pay for an order is the time of your order — it is not the date or time the letter is mailed, postmarked, or sent. A letter is considered sent only when our third-party physical-fulfillment provider actually tenders it to the postal carrier, which typically occurs after a processing period (see Section 8) and may vary. We do not warrant or certify any specific mailing or postmark date or time. If you need a verifiable record of the date and time a letter was sent or delivered, you must select Certified Mail, which provides USPS tracking and a delivery record to the address; no such proof is available for standard First-Class letters.

No guaranteed postmark date; you must allow adequate lead time. Because the printing, posting, and postmarking of your letter are performed by the third-party fulfillment provider and the postal carrier — not by PostalGenie — we cannot and do not guarantee that any letter will be mailed, postmarked, or delivered by any particular date or time. To the fullest extent permitted by law, PostalGenie is not responsible or liable for any loss, damage, penalty, fine, fee, forfeiture, missed deadline, or other consequence of any kind arising from a letter being mailed, postmarked, or delivered later than you expected, needed, or required, including any court, statutory, regulatory, contractual, or other deadline. You are solely responsible for allowing sufficient lead time; if timely postmarking by a specific date or time matters, do not rely on the Service unless you submit your order with adequate lead time (we recommend at least 1 to 5 business days before the required postmark date).

12. Indemnification

You agree to defend, indemnify, and hold harmless PostalGenie (Sensing Apparatus LLC), its affiliates, officers, directors, employees, and its service providers (and their respective affiliates, officers, employees, agents, and subcontractors) from and against any and all third-party claims, demands, losses, damages, fines, and expenses (including reasonable attorneys’ fees) arising out of or related to the content of your letters (including claims of defamation, libel, or intellectual property infringement), your use or misuse of the Service, or your violation of these Terms or any applicable law.

We will use reasonable efforts to notify you of any claim for which we seek indemnification. We may, at our option, assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), in which case you agree to cooperate with our defense of that claim; you may not settle any such claim without our prior written consent. This obligation survives termination of these Terms and your use of the Service.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, DELIVERABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you; in that case, any such warranty is limited to the minimum scope and shortest duration permitted by applicable law.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POSTALGENIE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE FEES ACTUALLY PAID BY YOU TO US FOR THE SPECIFIC SERVICE TRANSACTIONS DIRECTLY GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100). These limitations apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above may not fully apply to you; in that case, our liability is limited to the smallest amount permitted by applicable law.

15. Termination

You may stop using the Service at any time. We may suspend, ban, or terminate your access, and refuse service, with or without notice, if we believe you have violated these Terms, if our systems detect tampering, suspicious, fraudulent, or otherwise inappropriate use, or to protect the Service or others. Sections that by their nature should survive termination (including Sections 6–9 and 11–14 and 16–17) will survive.

16. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Subject to Section 17, the state and federal courts located in Wyoming have exclusive jurisdiction over any dispute not subject to arbitration.

17. Dispute resolution; arbitration; class-action waiver

Please read this section carefully — it affects your legal rights. Before filing a claim, you agree to first contact us at support@postalgenie.app and attempt to resolve the dispute informally for at least 30 days.

If the dispute is not resolved, you and PostalGenie agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be held in Wyoming or, at your election, in your home county, or conducted remotely. The payment of AAA consumer filing, administration, and arbitrator fees will be governed by the AAA Consumer Arbitration Rules, including any hardship fee waivers.

Class-action waiver. You and PostalGenie agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, mass, or representative proceeding. The arbitrator may not consolidate more than one person’s claims. You and PostalGenie waive any right to a jury trial. Notwithstanding the foregoing, nothing in this section shall be construed to waive any right to seek public injunctive relief to the extent such waiver is prohibited by applicable law.

You may opt out of this arbitration agreement by emailing support@postalgenie.app within 30 days of first accepting these Terms; opting out does not affect any other part of these Terms.

Time limit to bring a claim. To the fullest extent permitted by law, any claim or dispute arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose; otherwise, it is permanently barred, except where prohibited by applicable law.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “last updated” date above and, where appropriate, provide notice. Continued use after a change means you accept the revised Terms.

19. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and PostalGenie regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Specifically, if any portion of the arbitration, class-action waiver, mass-action waiver, or public-injunctive-relief waiver is found to be unenforceable, only the unenforceable portion shall be severed (unless applicable law requires otherwise), and the remainder of the arbitration section shall remain in full force and effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control. Our service providers are intended third-party beneficiaries of the protections, disclaimers, limitations, and indemnities in these Terms to the extent claims relate to services they provide for PostalGenie. Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between you and PostalGenie.

Electronic communications and signatures. By using the Service, you consent to receive communications, agreements, notices, and disclosures from us in electronic form — by email or by posting within the Service — and you agree that these satisfy any legal requirement that such communications be in writing. You agree that your electronic actions — including clicking to accept, checking a consent box, or otherwise using the Service — constitute your signature and your agreement to these Terms, and have the same legal effect as a handwritten signature. You may withdraw this consent only by ceasing to use the Service.
